Stormwater is an important issue these days, and there is no better place in which the push and shove can be seen than the court system. The most recent U.S. Supreme Court case in which stormwater takes front and center is Decker v. Northwest Environmental Defense Center (NEDC).  In this case, the Supreme Court ruled that runoff from logging roads does not constitute a discharge from a point source and require an NPDES permit.  Additionally, the Supreme Court upheld the commonly cited precedent that requires judicial deference to an agency’s interpretation of its own rule. Previously, EPA had interpreted that its stormwater permit regulation extends only to traditional industrial buildings and other relatively fixed industrial sites.
