EPA announced its semiannual regulatory agenda on July 3rd, 2013.  Here are some items of note that appeared in the announcement.  I’ve also included the dates, if known, that EPA will consider these items:

  • 10/2013: EPA will complete its review of the impact to small entities of CAFO permits.  This looks to be positive for small to medium farms.
  • 2014: EPA will complete its update for effluent limitations guidelines and standards for electric power generation plants.
  • No clear date: EPA and the Corps of Engineers will continue to re-define “waters of the U.S.”
  • 2014: EPA will issue a proposed rule establishing effluent guidelines and standards for “fracking.”
  • No clear date: EPA will continue developing a rule governing stormwater discharges from newly developed and redeveloped sites.
  • No clear date: EPA will consider issuing a rule establishing standards for managing coal combustion residues.
