SMG has extensive experience with environmental permitting associated with new development and facility expansions.  We also provide airport airspace analysis services related to Federal Aviation Administration (FAA) and state airport zoning agencies obstruction evaluation and permitting.

The requirements for filing with the FAA for proposed structures vary based on a number of factors including structure height, proximity to an airport, location, and frequencies emitted from the structure, etc.  Tall structures (greater than 200 feet above ground) require notice.  Shorter structures can also require notice if they are within 20,000 feet of a runway or are near instrument approach areas or navigation facilities.  You must file with the FAA at least 45 days prior to construction if filing is required by the FAA.  For more details, please reference the code of Federal Regulations CFR Title 14 Part 77.9.  To quickly see if your proposed structure requires notice, visit the FAA’s Obstruction Evaluation Notice Criteria Tool and enter the proposed structure’s coordinates and elevations.

State notice and permitting requirements may also apply.  The Kentucky Airport Zoning Commission (KAZC), an entity within the Department of Transportation, approves and permits structures within Kentucky jurisdictional limits.  Visit the KAZC website for a reference to applicable Kentucky statutes and permitting instructions.  Other state’s aviation contacts are identified on the FAA website at this link.
