Today, March 25, 2014, EPA and the U.S. Army Corps of Engineers have released a proposed rule defining “waters of the US”.  This proposed rule is 371 pages long.

Due to questions arising from several Supreme Court cases on the issue over the past decade, many affected industries, agencies and citizens have asked for clarification so we can operate under a well-reasoned set of rules.  EPA states they have provided just that.  See for yourselves at http://www2.epa.gov/uswaters.

SMG is analyzing this proposal on behalf of our clients in agriculture, mining, and construction.  But each of us will likely be impacted.  Stay tuned in this spot for news as we determine who wins and who loses with this proposed rule.  And pay close attention to the comment period.  These rules are not final yet.
